Employers can be held liable for an employee’s negligence where they expressly authorised the employee to act as they did. For example, if they instructed the employee not to undertake a risk assessment, and that failure led to an accident in which you were injured, you may be entitled to compensation from your employer. In some cases, employers can be held liable for their employees’ negligence even if they weren’t directly involved in it. This is known as ‘vicarious liability’.
