The figures shown come from the latest edition of the Judicial College Guidelines. They only relate to ‘general damages’, i.e., compensation for pain and suffering (physical and mental injury) and loss of amenity (compensation for the injury’s effect on your enjoyment of life). General Damages do not include special damages; financial losses such as loss of earnings for taking time off work to recover.

Whiplash Injuries

In May 2021, the government introduced the whiplash reforms. In brief this means that if you are over 18 and the driver or passenger in a car involved in a road traffic accident on or after 31st May 2021, and you suffer a whiplash injury, you will now be restricted to claiming a fixed amount as set out in the table below.

The new rules do not apply to whiplash injuries sustained in accidents at work or slip, trip or fall accidents and they do not apply to:

  • Pedestrians
  • Cyclists
  • Motorcyclists (and pillion passengers)
  • Scooter riders
  • Minors – persons under 18 years of age

The reforms mean that if your whiplash injury falls to be dealt with under the whiplash reform tariff, and the total value of your claim is less than £10,000, you will not recover any legal costs in pursuing a whiplash injury claim.
