What are the main causes of Pedestrian Accidents?

Accidents to pedestrians can be caused in a whole number of ways but the following are some of the more common ones;

  • Drivers going too fast
  • Reckless driving (eg overtaking in a built-up area)
  • Driver not paying attention – talking on a mobile phone whilst driving, eating whilst driving, trying to alter the in-car sound system or sat nav. They look away for an instant and an accident may result
  • Driver going through red traffic light
  • Failing to stop for a pedestrian on zebra or pelican crossings. Drivers and other road users must stop at a zebra crossing if the pedestrian has stepped out with even with one foot onto the crossing
  • Aggressive driving e.g. road rage
  • Road user under the influence of alcohol or drugs
  • Where a driver is performing a right-hand turn (there is more chance of a driver and crossing pedestrian looking in opposite directions, than when the driver is performing a left turn)

As a Pedestrian Can You Ever Be to Blame when you come into collision with another road user?

  • If you are walking wholly on the designated pavement and another road user mounts the pavement and collides with you, then the accident in 99% of cases is the fault of the other road user. Even if the other vehicle does not hit you, but you see him and jump out of the way, thus injuring yourself, then you still have a strong case for claiming compensation
  • If you correctly use a zebra or other crossing and are hit and injured by a vehicle whilst doing so, then your pedestrian compensation claim against the driver, will be highly likely to succeed in full
  • If you decide to cross a road from in between two parked vehicles or you simply crossed a road without looking to see whether anything was coming, then providing the other road user was not speeding, then making a compensation claim as the pedestrian may be problematic, or at least mean that you are held partly responsible for the accident

How long have I got to make a pedestrian accident compensation claim?
You have three years from the date of the accident causing your injury, within which to make a claim. If the claim is for a child under the age of 18, then the three-year time limit does not start until the child reaches 18. In all cases, though, it is advisable to seek out legal assistance as soon as possible after the accident, with a view to making a claim.
